1.期間的計(jì)算方法期間的計(jì)算方法有兩種，一是自然計(jì)算法，即以實(shí)際經(jīng)過的時(shí)間為計(jì)算期間的時(shí)間。例如，9月9日下午5時(shí)到9月16日上午10時(shí)，期間分秒不差。二是歷法計(jì)算法，即以日歷所定的年、月、日為計(jì)算單位，所稱年，不論平閏年一律定為365日，所稱月不論大小皆為30日。歷法計(jì)算法雖不精確，然頗為便利。依民法通則第154條規(guī)定，兩種期間計(jì)算方法并存，法定或指定期限多用歷法計(jì)算法，而約定期限，允許當(dāng)事人選擇，如未約定何種計(jì)算方法，則推定以歷法計(jì)算法確定其約定期限。2.期間的始期與終期(1)始期以小時(shí)計(jì)算期間的，從規(guī)定時(shí)開始計(jì)算;以年、月、日計(jì)算期間的，其開始當(dāng)天不算入，從下一天開始計(jì)算。但當(dāng)事人對(duì)此有約定的，按約定計(jì)算。人的年齡，自出生之時(shí)起計(jì)算，其起算點(diǎn)，包括出生之日，此為例外。(2)終期期間的最后一天是星期六、日或其他法定休假日的，以休假日的次日為期間的最后一天;休假日有變通的，以實(shí)際休假日的次日為期間的最后一天。期間最后一天的截止時(shí)間為24時(shí)。有業(yè)務(wù)活動(dòng)時(shí)間的，截止到停止業(yè)務(wù)活動(dòng)的時(shí)間。
